Color Me Hobbs 2018 Official Rules

Official Rules August 16, 2018

NO PURCHASE NECESSARY TO ENTER OR WIN the Color Me Hobbs Giveaway ("Giveaway" or "Giveaways"). A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. ELIGIBILITY:

The Giveaway is open only to U.S., D.C. and Canadian residents (excluding residents of the Province of Quebec) who are physically located in the U.S., D.C. or Canada (excluding Quebec) and are the age of majority or older in their state or province at the time of entry. Entrants must have a valid e-mail account. The Giveaway's Sponsor is Spectrum Brands, Inc. ("Sponsor").

If you do not meet all of the eligibility requirements in these Official Rules, you are not eligible to win a Prize. Employees, directors, officers and contractors of Sponsor its affiliated entities, advertising and promotion agencies and their immediate families or those living in the same household of each are not eligible to enter the Giveaways. The promotions are subject to all applicable federal, state, provincial and local laws and regulations and are void where prohibited or restricted by law. Chances of winning these Giveaways depend on the number of eligible posts with responses to Sponsor's posed questions received during the Promotion Period (defined below).

2. TO ENTER ONE OR MORE GIVEAWAYS:

The Giveaways will begin at 12:00 p.m. (CDT), on August 16, 2018 and end at 11:59 p.m. (CDT), on September 06, 2018 ("Promotion Period"). During the Promotion Period there will be a drawing once a week starting on August 23, 2018 for six [6] weeks. One winner will be randomly selected on each of the following dates: August 23, 2018; August 30, 2018; September 06, 2018; September 13, 2018; September 20, 2018; and September 27, 2018.

To be officially entered for a chance to win and become a Participant, eligible entrants will go to the Giveaway's web address (www.russellhobbs.com/colormehobbsgiveaway) during the Promotion Period, and sign up with their name, e-mail address, and birthdate. Properly completing the entry will give the Participant an individualized link that allows Participant to earn more entries into the Giveaway by doing any of the following:

Refer a friend. (One [1] additional entry per friend who visits the Giveaway's web address through Participant's individualized link)
Referred friend enters the giveaway through Participants individualized link. (Two [2] additional entries into the Giveaway)
Sharing Participant's individualized link on Facebook. (Five [5] additional entries into the Giveaway)

In the event of a dispute as to the identity of a Participant, entries will be deemed submitted by the authorized account holder of the e-mail account from which it was sent. The authorized account holder shall be the natural person to whom the applicable e-mail account has been assigned.

On each drawing date, Sponsor will select winners at random from the Participants. The winner will be subject to verification and be contacted via e-mail ("Notice"). The winner must respond with his/her full name, address and email address within 72 hours after the drawing or be disqualified at Sponsor's sole discretion.

In order to be declared a winner, each selected Canadian participant who is eligible for a Prize will be required to confirm that they have correctly answered the mathematical skill-testing question below:

Step 1 Multiply 600x200;
Step 2 Add 6000 to the answer from Step 1;
Step 3 Divide the answer from Step 2 by 5;
Step 4 Subtract 5000 from the answer to

By entering these Giveaways, Canadian Participants acknowledge and agree that: (a) each voluntarily entered this Giveaway(s) and (b) each will voluntarily give Sponsor, if a winner, his or her email address and mailing address and (c) he or she has the opportunity to opt out of receiving any subsequent notice from Sponsor and any of its affiliated and associated companies about their products and services.

3. PRIZES:

One prize will be awarded after each drawing during the Promotion Period. Each prize will be: one Russell Hobbs appliance of Participant's choice; one Pepper Mill Set of Participant's choice; and a $50 (USD) Sur La Table gift card ("Prize" or "Prizes"). The value of each prize ranges between $160-210 USD. The total value of all Prizes will not exceed $4999.99 USD. All federal, state, provincial and local tax liabilities are the sole responsibility of each winner as are all costs, fees and expenses associated with accepting, receiving or using the Prize. No cash alternative, transfer, substitution, or cash equivalent for a Prize is permitted, except by Sponsor in its sole discretion. Sponsor may post the winners' first name and last initial on its social media pages. Prizes will be shipped no later than eight [8] weeks after the end of the Promotion Period.

4. AWARD OF PRIZES:

Sponsor is not responsible for any change in Participant's mailing address, e-mail address and/or telephone number. The decisions of the Giveaway judges (who are employees of Sponsor) shall be final in all matters relating to the Giveaways. If a winner is found to be ineligible or declines acceptance of a Prize for any reason, an alternate Prize winner may be selected. By entering this Giveaway(s) and/or accepting a Prize, each Participant consents (except where prohibited by law) to the reasonable use by Spectrum of his/her photograph, likeness and/or image, hometown address, and first name and last initial without further compensation or acknowledgement for any future promotional activity, unless prohibited by law.

5. CONDITIONS:

Further, Sponsor is not responsible for any injury or damage to Participants or any other person's computer or device related to or resulting from participating in or downloading any materials in the Giveaways or for any electronic mail that is late, lost, misdirected, damaged, incomplete, or illegible. Sponsor reserves the right to terminate or modify these Giveaways or these Official Rules at any time for any reason including but not limited to any intervention with the Giveaways beyond the control of Sponsor. In such a circumstance, winner(s) will be selected based on responses received to the date and time of termination. Sponsor reserves the right to disqualify entries that in its sole discretion include tampering with the entry process or the operation of the Giveaways, or to be acting in violation of these Official Rules or in a disruptive manner or have failed to agree to these Official Rules or Privacy Policy. Participants and winners agree to indemnify Sponsor, Facebook, Twitter, Instagram, and their affiliates, subsidiaries, divisions, parents and related companies from and against any and all claims, damages and liabilities of any kind arising in whole or in part, directly or indirectly from the acceptance, possession, use or misuse of the Prizes in connection with these Giveaways, including but not limited to participating in the Giveaway(s).

6. LIMITATION OF LIABILITY/GOVERNING LAW:

IN NO EVENT SHALL SPONSOR, FACEBOOK, TWITTER, OR INSTAGRAM, OR THEIR PARENTS, AFFILIATES, SUBSIDIARIES, AND RELATED COMPANIES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AGENTS, CONTRACTORS, SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE "RELEASEES") BE RESPONSIBLE FOR ANY CLAIMS, ACTIONS, DEMANDS, LOSSES, LIABILITIES, DAMAGES, COSTS AND EXPENSES (INCLUDING, ATTORNEYS' FEES) OF ANY KIND, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE, ARISING OUT OF PARTICIPATION IN THE GIVEAWAY(S), THE ACCEPTANCE, POSSESSION, USE, MISUSE, LOSS OR MISDIRECTION OF THE PRIZE(S), PARTICIPATION IN ANY GIVEAWAY RELATED ACTIVITIES OR ACCESS TO AND USE OF ANY INTERNET SITE, AND PARTICIPANT AGREES TO RELEASE, DEFEND, INDEMNIFY, DISCHARGE AND HOLD HARMLESS THE RELEASEES FROM ANY SUCH CLAIMS, ACTIONS, DEMANDS, LOSSES, LIABILITIES, DAMAGES, COSTS AND EXPENSES, INCLUDING, WITHOUT LIMITATION FROM ANY DAMAGE, INJURY, DEATH, LOSS OR OTHER LIABILITY EITHER AT LAW OR EQUITY WHETHER KNOWN OR UNKNOWN, ASSERTED OR NOT ASSERTED THAT MAY ARISE FROM OR IN ANY WAY RELATE TO PARTICIPATION IN THE GIVEAWAY(S), OR THE AWARDING, ACCEPTANCE, USE OR MISUSE OF THE PRIZE(S). WITHOUT LIMITING THE FOREGOING, THE GIVEAWAYS AND THE PRIZES ARE PROVIDED "AS-IS" WITHOUT ANY WARRANTY (EXCEPT FOR MANUFACTURERS' WARRANTIES, IF ANY) OR REPRESENTATION OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

These Giveaways will be governed by and construed in accordance with the laws of the state of Wisconsin, without giving effect to any choice of law or conflict of laws rules or provisions. Except where prohibited by law, as a condition of participating in the Giveaway(s), Participants agree that (a) any and all disputes and causes of action arising out of or connected with these Giveaways shall be resolved without any form of class action, (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (c) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively "Special Damages"), and (d) Participants hereby waive all right to claim Special Damages and all rights to have such damages multiplied or increased.

7. CONSUMER INFORMATION

If you wish to receive the name of the Prize winners, or have any questions about these Giveaways, specify your request and write to: Remington Promotions, 3001 Deming Way, Middleton, WI 53562. Information collected from Participants is subject to the Spectrum's Privacy Policy which can be found at http://spectrumbrands.com/privacy/#. Facebook, Twitter, and Instagram are not involved in the collection, gathering, or retention of information collected from Participants in the Giveaways. However, by participating you elect to receive occasional updates, special offers and other information from Sponsor and its affiliated and associated companies about their products and services and agree your e-mail address may be shared with those companies. On any notice you receive, you will have the opportunity to choose not to receive any subsequent notices.

Canadian Participants understand that their personal information will be retained by the Sponsor in the United States and that the United States governments, courts or law enforcement or regulatory agencies will be able to obtain disclosure of this information through the laws of the United States. Each Participant from Canada, if any, hereby consents under Canada’s Anti-Spam Legislation to receive emails and any other form of commercial electronic message ("CEM") from Sponsor and its subsidiaries. Further, such Participants understand that they have the opportunity to choose not to receive any subsequent CEM and opt out of the email list

8. Entire Agreement:

These terms set forth the entire agreement between the parties relating to the subject matter hereof, and supersede all prior agreements and understandings relating thereto, whether oral or written. Facebook, Twitter, and Instagram are not sponsors, endorsers, or administrators of these Giveaways. You are providing your information to Sponsor. The information you provide will only be used as described in these Official Rules.
